1. Acceptance of these terms
These Terms & Conditions govern your use of StudioLeese.com and purchases made through the site. By visiting the site, creating an account, joining our mailing list, or placing an order, you agree to these terms and to any policies referenced on the site. If you do not agree, please do not use the site.
2. About Studio Leese
Studio Leese is the creative home of Lisa Ferron and related artistic projects, including The Haunted Pumpkin Patch and work associated with Mountain Street Designs. References to “Studio Leese,” “we,” “us,” or “our” in these terms include the artist and authorized associates involved in operating the site and fulfilling orders.
3. Products, handmade work, and images
Many Studio Leese creations are handmade or artist-designed. Natural variation is part of the work. Product photographs and artist-rendered representations are intended to show the design and overall appearance; actual color, artwork placement, scale, texture, dimensions, finish, and other details may vary slightly from images shown on a screen. We make reasonable efforts to describe products accurately but do not warrant that every display or description will be exact.
4. Orders, prices, and availability
Prices and availability may change without notice before an order is placed. We reserve the right to correct errors, refuse or cancel orders where permitted by law, limit quantities, or discontinue products. An order confirmation acknowledges that we received your order; it does not waive our right to address a pricing, inventory, fraud, or other material error.
5. Preorders and production timing
Some items may be offered for preorder or made in production runs based on customer orders. Estimated production and shipping windows are estimates rather than guaranteed delivery dates unless expressly stated otherwise. For the current Haunted Pumpkin Patch preorder collection, please allow 3-4 weeks after the preorder ends for your order to ship. Shipping charges are calculated separately at checkout where applicable.
6. Shipping, delivery, returns, and refunds
Shipping times begin after an order is ready to ship and may be affected by carriers, weather, holidays, customs, or other circumstances beyond our reasonable control. Any return, exchange, cancellation, or refund rights are subject to the return/refund information presented on the site and to rights that cannot legally be waived. Please review product-specific information before ordering.
7. Intellectual property and artist rights
Unless otherwise stated, the site and its original content—including photographs, illustrations, pumpkin designs, sculptures and craft designs, graphics, logos, product artwork, written copy, videos, tutorials, trade dress, and other original creative work associated with Lisa Ferron, Studio Leese, Mountain Street Designs, The Haunted Pumpkin Patch, and authorized collaborators—are owned by or licensed to the applicable artist or rights holder and are protected by copyright, trademark, trade dress, and other intellectual-property laws where applicable.
You may view and share links to our public pages for personal, noncommercial purposes. You may not copy, reproduce, manufacture from, sell, license, scrape, republish, modify, distribute, remove watermarks or attribution from, or commercially exploit our original images, artwork, designs, tutorials, text, or other protected material without prior written permission from the applicable rights holder.
8. Acceptable use
You may not misuse the site, interfere with its security or operation, attempt unauthorized access, submit unlawful or fraudulent information, violate another person’s rights, or use the site or its content for unlawful purposes.
9. Email communications
If you voluntarily subscribe to Studio Leese or Haunted Pumpkin Patch email updates, you agree to receive the communications you requested. You may unsubscribe using the link provided in marketing emails. Transactional messages related to an order or account may still be sent when necessary.
10. Third-party services and links
The site may rely on or link to third-party services, including Shopify, payment processors, shipping carriers, and social platforms. Their services may be governed by separate terms and privacy practices. We are not responsible for third-party websites or services that we do not control.
11. Disclaimers
To the fullest extent permitted by law, the site and its content are provided on an “as available” basis without warranties that are not expressly stated. Nothing in these terms excludes any warranty, remedy, or consumer right that cannot legally be excluded.
12. Limitation of liability
To the fullest extent permitted by law, Studio Leese and its artists or authorized associates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the site or products. Any limitation in these terms applies only to the extent permitted by applicable law and does not limit rights that cannot legally be waived.
13. Changes to these terms
We may update these Terms & Conditions from time to time. The revised version will be posted on this page with an updated date. Continued use of the site after a change means the revised terms apply to future use, subject to applicable law.
14. Governing law
To the extent permitted by applicable law, these terms are governed by the laws of the Commonwealth of Pennsylvania and applicable United States federal law, without limiting any mandatory consumer protections that may apply based on your location.
